The paper addresses the contemporary shape of the general part of public economic law under the conditions of the regulatory state. The growth of sectoral regulation and the transformation of the functions of public administration do not lead to the disappearance of the general part of this field of law, but to a shift in the plane of its integration – from an institutional to an axiological and functional one. The analysis begins with the classical model developed in Polish doctrine and discusses the evolution of state functions from an administering to a regulatory model, devoting particular attention to the Act of 6 March 2018–Law of Entrepreneurs as a normative expression of this transformation. The paper proposes a three-tier model for reconstructing the general part: axiological, functional, and institutional.
