The procedure regulated by the law of August 11, 2021 on open data and the re-use of public sector information has, like any other procedure, its own rules. These rules are intended to ensure that the process runs smoothly for the benefit of both parties to the process: the right holder and the information provider. The analysis of these rules is the basis for an internal classification of the information in accordance with a suitable selection criterion. It allows, among other things, to distinguish between subjective rules, which are strictly related to the rights of the entity referred to in the regulations as the user, and those relating to the applicant. The provisions of the Act that form the basis for characterizing such principles in their internal confrontation with the provisions of the Act of September 6, 2001 on Access to Public Information are discussed in this study.
