Treści generowane przez sztuczną inteligencję a ochrona różnorodności form wyrazu kulturowego

Abstrakt

Artykuł postuluje uznanie, przy spełnieniu wskazanych w nim warunków, treści generowanych przez sztuczną inteligencję za formy wyrazu kulturowego w rozumieniu Konwencji UNESCO z 2005 r. Omówiono również korzyści i ryzyka wynikające z zastosowania technologii sztucznej inteligencji dla różnorodności form wyrazu kulturowego oraz stan prawa pierwotnego UE dotyczącego różnorodności kulturowej. Przedstawiono również krytyczne uwagi dotyczące projektowanego rozporządzenia UE dotyczącego sztucznej inteligencji w kontekście udzielenia przez ten projekt adekwatnej odpowiedzi na zasygnalizowane wyżej korzyści i ryzyka.
