
In its decision of March 23, 2021, the Voivodeship Administrative Court in Warsaw dismissed the appeal and declared that the decisions denying the Ukrainian citizen refugee status and subsidiary protection were correct. The contested decisions and the verdict of the Voivodeship Administrative Court were issued before the Russian aggression against Ukraine. Nevertheless, the Supreme Administrative Court took into account the circumstances of the aggression when assessing the decisions taken before the aggression. In accordance with the principle of primacy and direct application of EU law, the provisions of Directive 2013/32/EU of the European Parliament and of the Council of June 26, 2013 formed the basis of the decision of the Supreme Administrative Court.
