
The Constitution of the Republic of Poland of 2 April 1997 does not explicitly formulate the content of the right to housing. However, it emphasises that public authorities pursue a policy conducive to satisfying the housing needs of citizens, in particular by combating homelessness, supporting the development of social housing and supporting citizens' actions aimed at obtaining their own dwelling (Article 75(1)). This raises the fundamental question of what is meant by the concept of the „right to housing” – whether it has an independent (separate) character or whether it is conjugated (resultant) understood as providing dedicated protection, the activation of which only materialises when the minimum subsistence of the individual and his/her immediate family members is threatened.
