
The construction process combines interests of various parties, especially interests of the investor and third parties in the area affected by the facility implemented by the investor. The realization of interests of these parties requires balancing their rights, especially ownership ones, enabling the development of their own real estate within the legal limits. By protecting the investor, legislator decided to limit the parties to the proceedings regarding the building permit and reduced the scope of protection by guaranteeing only „respect”, and not – as it was before 2003 – „protection” of legitimate interests of third parties. In addition, these interests are only protected during the designing and constructing
of the building. They no longer apply to using the facility. Respect of these interests depends on their occurrence in the area of the object’s impact.
