
The author presents the issues of the reception of the French Code of Civil Procedure on the territory of the Duchy of Warsaw. This process was different from the Napoleonic Code. The minister of justice, Feliks Łubieński, ruthlessly broke the resistance of politicians and the legal environment against
the implementation of the French civil code. Concerning the civil procedure, the minister kept far-reaching pragmatism because judges had just started to acquaint themselves with the regulations of this procedure, which was often doubtful and not clear, and the interpretation was possible only by analyzing the French tradition of judiciary.
