
The author describes the mechanism of determining criminal jurisdiction in court cases in which the accused would be a member of the US armed forces or their civilian
personnel or a family member of any of the indicated entities. This mechanism was established in Art. 14 and art. 15 of the Agreement between the Government of the Republic of Poland and the Government of the United States of America on enhanced defense cooperation, signed in Warsaw on August 15, 2020. The author also discusses a more detailed issue in the form of the possibility of qualifying the same act of the perpetrator
under Polish and American criminal regulations and the issue of the possibility of double conviction for the same act by a court of the United States of America and a court of the Republic of Poland.
