Stan wyjątkowy jako formuła przestrzenna: Amerykańskie więzienie w Abu Ghraib w kontekście filozofii prawa Carla Schmitta

Abstrakt

W artykule autor podejmuje próbę zanalizowania sytuacji prawnej amerykańskiego więzienia w Abu Ghraib przez pryzmat filozofii prawa Carla Schmitta. Stawia tezę, iż właśnie ten jest właściwy, ponieważ traktuje prawo jako przypisane do terytorium geograficznego. Analizuje instytucję unlawful combatant jako realizację schmittiańskiego konceptu partyzanta.
