The Legal Situation of a Doctoral Student in the Event of Health Condition Interrupting Education at the Doctoral School. Comments on the Background of the Judgment of the Voivodeship Administrative Court in Białystok of 30 March 2023 (II SA/Bk 75/23)

Abstract

The judgment of the Provincial Administrative Court in Białystok of 30 March 2023 (II SA/Bk 75/23) is an exemplification of one of the legal loopholes that very severely affects the legal, but also life situation of doctoral students. This loophole is the lack of regulation regarding the fate of doctoral students studying at a doctoral school whose health condition has deteriorated to the extent that it does not allow them to continue their education and fulfill their obligations, or at least allow them to take leave from their studies for the period of recovery. The paper analyzes this issue, also presenting de lege ferenda demands regarding the statutory regulation of the right to leave from studies at the doctoral school.
